1. Who we are
Dare Dating (“Dare”, “the app”) is provided by MAFLOMARIUS SRL, a Romanian legal entity with its registered office at Str. Lotrioara nr. 11, Sector 3, București, Romania, unique registration code (CUI) 36663373 (“we”). You can write to us at uppdare@gmail.com.
2. Your agreement
These terms are the contract between you and us. You accept them when you create your account, by ticking the box “I have read and accept the Terms and Conditions and I am at least 18 years old”. The Community Guidelines also form part of the contract. The Privacy Policy explains separately how we use your data.
If you do not agree with these terms, do not use Dare.
3. Who can use Dare
You can use Dare if:
- you are at least 18 years old and can legally enter into a contract;
- we have not previously closed a Dare account of yours for breaking the rules;
- you have not been convicted, by a final judgment, of a violent or sexual offence;
- the law of your country does not prohibit you from using this kind of service.
Each person can have only one account. Your account is personal: you may not lend it, sell it or use it on behalf of someone else.
4. Your account
- You sign in with your phone number and, if you wish, with a linked Google account. Look after them: everything that happens in your account is considered to have been done by you.
- If you lose your phone or think someone else is using your account, write to us straight away.
- The details in your profile must be true: your first name, your real date of birth, photos of you. Your date of birth is set only once.
5. How Dare works
- The deck: we show you people based on what you are looking for: gender, age and distance. You swipe the card up to send a Dare, down to move on (“Not now”; that person will not be shown to you again for a week), or you add them to your favourites for 48 hours.
- The Dare: you take a selfie on the spot, with the front camera, and ask a question. The other person sees the dare with your photo blurred and can answer within 24 hours with a selfie (Dare) or in writing (Truth), put it off once for 24 hours (“Later”) or decline it. After the answer, the photo is revealed for a few seconds and the conversation opens.
- The conversation: messages, photos (with the lock, if you like), voice messages, messages with the flame, which burn once they have been seen, and the “True or false?” game.
- Daredevil: a game you start only if you both want to. While it is on, if you go quiet for 12 hours and one of you writes again, the other sends a selfie first to see the message. Either of you can leave at any time, on your own.
- Civil Mode: a break during which nobody sees you, you get no notifications and the dares you have received do not expire.
- Search by name and choosing another city help you find particular people or people from somewhere else.
To stop abuse, some actions are limited per day (for example, at most 30 dares sent). The limits may change.
6. The rules
By using Dare, you agree to follow the Community Guidelines. In short, you must not:
- lie about who you are, use someone else's photos or have more than one account;
- harass, threaten, insult or discriminate against anyone;
- send explicit nudity, sexually explicit content, or violent or illegal content;
- pressure anyone to send photos or personal details, or to meet you;
- ask for money, sell anything, advertise or send spam;
- share someone else's conversations or photos without their consent;
- make false reports;
- use bots, automated programs or modified apps, collect data about users or try to get around our checks and limits.
7. Your content
Your photos, selfies, questions, answers and messages remain yours. So that the app can work, you give us a free, non-exclusive, worldwide right to store them, copy them technically, check them and show them to the people they are meant for, only while they are on Dare and for as long as it takes us to delete them from backups. We do not use them in advertising and we do not sell them.
You guarantee to us that you have the right to send what you send: that the photos show you or that you have the consent of the people who appear in them, and that you are not infringing anyone's rights.
Other people's content remains theirs. Do not copy it or share it without their consent.
8. Moderation and reporting
- Automatic checks: every photo is checked automatically before it reaches anyone; anything that fails is deleted. Texts are checked against a list of offensive words.
- Reports: in the app, you can report anyone from the chat menu. Anyone, even without an account, can notify us of illegal content at uppdare@gmail.com, saying where it is or describing it, and giving the reason.
- What we can do: delete or hide content, give a warning, limit some features, suspend or close an account. An account reported by several people may be put on hold automatically until we review it. We decide based on how serious it is, on what has happened before and on the law, and we may also take into account what happened outside the app.
- Statement of reasons: when we restrict your account or delete something of yours, we tell you why, except where the law forbids us to or it is spam.
- Appeals: if you think we got it wrong, write to us within 6 months at uppdare@gmail.com. A person on our team will check again and reply to you. You can also go to court or to an out-of-court dispute settlement body.
- Point of contact: for users and authorities, under Regulation (EU) 2022/2065 (Digital Services Act), our address is uppdare@gmail.com, in Romanian, English or Spanish.
We are not obliged to check everything sent on Dare in advance, and we cannot guarantee that we will find every breach.
9. Your safety
We do not run background checks on users. We do not check their identity, criminal record, health or intentions. The only checks are the date of birth declared at sign-up and the presence of a face in dare selfies. We are responsible only for what we do, not for how other users behave, in the app or outside it.
Be careful in conversations and on dates: do not give money, do not give out personal details, and meet for the first time in a public place. Read the Safety tips. If something is not right, report it; if someone is in danger, call 112.
10. Your right to use the app
We give you a personal, free, non-exclusive and non-transferable right to use the app for yourself, not for commercial purposes, for as long as you comply with these terms. You may not copy, modify, decompile or resell the app or any part of it.
App stores. You download Dare from Google Play or the App Store; their rules also apply to downloads and updates. Google and Apple are not parties to this contract and are not responsible for Dare; we are.
Other companies' services. Dare uses services from other companies, for example Google's servers or the maps on your phone, and may contain links to other websites. We are not responsible for the content or rules of those websites.
11. Paid features
At the moment, everything Dare offers is free. If we introduce paid features, we will describe them here first, and before any payment you will see the price, what you get, how long it lasts and whether it renews automatically. Payments will be made through Google Play or the App Store, and you will have all the rights the law gives you, including the 14-day right of withdrawal where it applies.
12. Ending the contract
- You: you can delete your account at any time, in the app (App Settings → Delete account) or by writing to us. See Delete your account. Uninstalling the app does not delete your account.
- We: we can suspend or close your account if you seriously or repeatedly break these terms or the Community Guidelines, if the law or an authority requires it, or if it is needed to protect other users. We will tell you why, and you can appeal the decision (see section 8).
- We may delete accounts that have not been used for more than 2 years, after letting you know.
After the contract ends, the clauses that by their nature must continue remain in force: those on content, liability and disputes.
13. Changes to the app and to the terms
Dare evolves: we may add, change or remove features. If a change affects you significantly, we will let you know in the app at least 30 days in advance and tell you what is changing and why, and if you do not agree, you can delete your account before the change takes effect. The date of the last update is always at the top of this page.
Sometimes we try out new features with only some of our users. Features on trial may have errors or may disappear; we will mark them as such.
14. What we promise and what we do not
We do our best to make Dare work well and be safe, and we are liable for defects in the app, as the law provides for digital services. However, we cannot promise:
- that you will receive dares or answers, or that you will meet someone;
- that other people are who they say they are or have the intentions they claim;
- that the app will work without any interruption, on every phone;
- that messages with the flame or photos with the lock cannot be copied by the other person, for example with a screenshot.
15. Liability
We are liable to you in accordance with the law. Nothing in these terms limits our liability for damage caused intentionally or through gross negligence, for death, personal injury or harm to health, or in respect of the rights the law gives you as a consumer.
To the extent permitted by law, we are not liable for how other users behave, for the content they send, for indirect losses, or for problems caused by your phone, your internet connection or services we do not control.
You, in turn, are liable in accordance with the law for any damage you cause us by breaking these terms, including claims by others against us caused by your content.
16. The name, the logo and the app
The names Dare and Dare Dating, the logo, the app, the website and their texts belong to us or are used by us lawfully. You may not use them without our written consent. If you think something on Dare infringes your copyright, write to us at uppdare@gmail.com.
17. The law and disputes
The contract is governed by Romanian law. If you are a consumer and live in another country of the European Union, you still have the protection given to you by the mandatory laws of your country.
If a problem arises, write to us first: most problems are resolved quickly. If we cannot reach an agreement, you can turn to the Romanian National Authority for Consumer Protection (ANPC), including through the alternative dispute resolution (ADR) procedure, or to the competent courts. As a consumer, you can also sue us in the courts where you live.
18. Final provisions
- These terms, together with the Community Guidelines, are the entire agreement between us about Dare.
- If a clause is found to be invalid, the others remain valid.
- If we do not immediately insist on a clause being respected, this does not mean that we are waiving it.
- We may transfer the contract to another company that takes over Dare, provided that your rights remain the same; we will let you know in advance. You may not transfer it to anyone else.
- The terms exist in Romanian, English and Spanish. All versions are equally valid.
- We send you communications about the contract in the app or, if you have given us an address, by e-mail.
- We are not liable for delays or interruptions caused by events we cannot control, such as outages at major internet or server providers, natural disasters or decisions by the authorities; however, we do everything we can to get Dare working again as quickly as possible.
